Mediation Checklist
Þ Send a brief summary of your case to Burdin. This can be in narrative form, or your original petition or answer.
Þ Explain the mediation process to your client . If possible, give your client a copy of the Agreement to Mediate.
Þ Don’t “draw a line in the sand.” You may learn things at mediation that will change your perspective.
Þ Thoroughly discuss with your client what you are seeking at mediation and what strategy you will pursue.
Þ Save your adversarial hat for the court room. Mediation is about resolution of a dispute, not winning a war.
